Supreme Court Backs Immigrant in Voluntary Departure Deadline Case
The Supreme Court ruled unanimously in Monsalvo Velázquez v. Bondi, making it easier for immigrants to meet voluntary departure deadlines under federal immigration law. The case involved Monsalvo Velázquez, who filed a motion after his 60-day voluntary departure period fell on a Saturday, but was denied because the Board of Immigration Appeals counted calendar days without considering weekends.
The Court held that when a voluntary departure deadline falls on a weekend or legal holiday, it extends to the next business day. This decision strengthens immigrant protections and ensures fairer procedural timelines in removal cases.
